1. Introduction

  • Agreement to Terms: These Terms and Conditions govern your use of the Treasures Untold website and constitute a legally binding agreement between you (the "Customer") and Treasures Untold (the "Company," "we," "us," or "our"). By accessing or using our website, you agree to be bound by these Terms.

  • Company Details: Treasures Untold is the business name under which we operate, selling furniture paint, brushes, decoupage, tools, bespoke furniture commissions, and workshops.

2. Products and Services

  • Product Descriptions: We attempt to be as accurate as possible in the descriptions of our products (paint, brushes, decoupage, tools, and furniture). However, we do not warrant that product descriptions or other content on the website are accurate, complete, reliable, current, or error-free.

  • Colour Accuracy: While we strive to display product colours as accurately as possible, the actual colours you see will depend on your monitor, and we cannot guarantee that your monitor's display of any colour will accurately reflect the product colour.

  • Pricing: All prices are as stated on the website and are subject to change without notice. All prices include applicable taxes unless otherwise stated.

3. Orders, Payments, and Cancellations

  • Order Acceptance: All orders placed through our website are subject to acceptance by us. We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available, errors in product or pricing information, or issues identified by our fraud prevention services.

  • Payment: Payment must be received in full before an order is processed and shipped or before a workshop/commission is confirmed. We accept various payment methods as detailed on the website.

  • Cancellation by Customer (Products): You may cancel an order for physical products (paint, tools, etc.) before it has been shipped. Once a shipping confirmation is sent, the order falls under our Returns Policy.

  • Cancellation by Customer (Workshops): We aim to be as flexible as possible should your plans change. For cancellations made 7 days or more before the workshop, we offer a full refund or reschedule.

If you cancel less than 7 days prior, a 50% fee applies, or you may transfer your spot to a friend. Please note that we cannot provide refunds for cancellations made within 24 hours or for no-shows.

4. Shipping, Collection, and Delivery

  • Scope: This section applies to the delivery of physical products and the collection of furniture. Refer to our separate Shipping Policy for full details.

  • Shipping (Small Items): We will ship small items (paint, brushes, decoupage, tools) to the address provided during checkout. Shipping times are estimates and not guarantees. We will ship within Australia only.

  • Furniture Collection/Transport: Bespoke furniture pieces will not be shipped by Treasures Untold unless agreed with Sarah Goodwin.

    • Collection: You may collect the finished item from our location at a pre-arranged time.

    • Arranged Transport: You may arrange and pay for a third-party courier/transport service. We will assist with handover but take no responsibility for the item once it has left our premises.

    • Delivery Liability: Risk of loss and damage for all products passes to you upon our delivery to the carrier (for small items) or upon collection/handover (for furniture).

5. Returns and Refunds

  • Returns Policy: Our full Returns Policy forms part of these Terms and Conditions.

  • Change of Mind:  Due to the nature of our paint and paint accessories, returns for change of mind are not accepted.

  • Faulty/Damaged Goods: If our paints or supplies are delivered damaged or are faulty, please contact us immediately. We will arrange for a replacement or a full refund, including return shipping costs.

  • Bespoke Commissions: Bespoke furniture items are non-returnable and non-refundable unless they are found to be faulty or not as described in the commission agreement.

6. Bespoke Furniture Commissions

  • Contract: Each bespoke furniture commission will be governed by an agreement outlining the scope of work, materials, finish, price, payment schedule, and completion estimates.

  • Payment Schedule: A non-refundable deposit of 50% is required to commence work. The final balance is due upon completion.

  • Completion Time: Completion times are estimates. We are not liable for reasonable delays due to unforeseen circumstances.

7. Limitation of Liability

  • To the fullest extent permitted by law, Treasures Untold shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use the website or the products purchased.

8. Intellectual Property

  • All content on the website (text, images, logos, etc.) is the property of Treasures Untold and is protected by copyright laws.

9. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia.
